Successfully Resolving Probate Sale Pricing Concern

At Shafritz & Dean, we pride ourselves on facilitating smooth real estate transactions, even when unexpected challenges arise. Recently, we assisted an investor under contract to purchase a property from an estate, a sale that had already been approved by the probate court. However, during the inspection process, additional defects were discovered, prompting both parties to negotiate a reduced sales price.

While the buyer and seller agreed to the price adjustment, the seller was concerned that another probate court approval would be required for the revised terms. This added a layer of complexity, as navigating the probate process can be time-consuming and uncertain.

Understanding the seller’s concern, our firm stepped in to provide a practical solution. We offered to petition the probate court on the seller’s behalf to obtain approval for the amended sales price. This proactive approach ensured that the transaction could proceed without unnecessary delays or legal complications.

Our petition to the probate court successfully secured approval for the revised price, allowing both the buyer and seller to move forward with confidence. The investor was able to purchase the property at a fair value reflecting its condition, while the seller complied with probate requirements without additional burden.

This case exemplifies our commitment to resolving real estate challenges efficiently and effectively. At Shafritz & Dean, we understand the intricacies of probate sales and work diligently to protect our clients’ interests, ensuring that all parties walk away satisfied.
